Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pyntra ("Service"), operated by WHUT.AI LLC, a Delaware limited liability company ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

"Pyntra" refers to the web application at pyntra.ai, including all features, tools, APIs, and related services we provide.

1. Eligibility

You must be at least 13 years old to use Pyntra. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

2. Account Registration & Security

To access most features, you must create an account with a valid email address and password. You agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials secure and not share them with others.
• Notify us immediately at support@pyntra.ai if you suspect unauthorized access.

You are responsible for all activity that occurs under your account, whether or not you authorized it.

3. Service Description

Pyntra is an AI-powered presentation generator. You describe what you need in natural language, and our AI creates professional slide decks. Features include AI slide generation, brand kit management, image uploads, presentation sharing, and export capabilities. We may add, modify, or discontinue features at any time.

4. AI-Generated Content

Pyntra uses third-party AI models (currently Anthropic Claude) to generate presentation content based on your prompts and inputs.

Ownership. You own the presentations you create using Pyntra, including AI-generated content within them, subject to any third-party rights (such as stock images from Unsplash — see Section 6). You are free to use your presentations for personal and commercial purposes.

No guarantees. AI-generated content may contain inaccuracies, errors, or unintended outputs. You are solely responsible for reviewing, editing, and verifying all content before publishing, sharing, or relying on it. We do not guarantee the accuracy, completeness, originality, or non-infringement of AI-generated outputs.

Your responsibility. You must not use the AI features to generate content that is illegal, harmful, defamatory, or that infringes on the rights of others. You are ultimately responsible for all content in your presentations, regardless of whether it was AI-generated.

Service improvement. We may analyze your interactions, generated layouts, and User Content to troubleshoot issues, enhance features, and train, fine-tune, or improve our proprietary AI models and presentation algorithms. However, we will not share or sell your raw, private presentation data to train unrelated third-party AI foundation models. See our Privacy Policy for details.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or to violate any laws.
• Generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Attempt to generate content that exploits minors, promotes violence, or constitutes hate speech.
• Infringe on the intellectual property rights of others.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service, servers, or networks.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Attempt to access other users' accounts, data, or presentations.
• Resell, redistribute, or sublicense the Service without authorization.
• Circumvent rate limits, usage quotas, or other technical restrictions.

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice.

6. Intellectual Property

Your content.You retain all rights to the content you create, upload, or input into Pyntra ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely for the purpose of providing, maintaining, and improving the Service for you.

Our IP. Pyntra, including its software, design, branding, logos, UI/UX, templates, and documentation, is owned by WHUT.AI LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond what is needed to use the Service.

Third-party content. The Service may include content from third parties, such as stock images from Unsplash. Your use of such content is subject to the respective third-party licenses (e.g., the Unsplash License). You are responsible for complying with those terms.

Feedback. If you provide us with suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, royalty-free license to use and incorporate that feedback without obligation to you.

7. Subscriptions, Payments & Refunds

Pyntra offers free and paid subscription plans (Creator, Pro). Paid plans provide additional features and higher usage limits.

Billing. All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selection). Prices are listed in US dollars unless otherwise stated and may be subject to applicable taxes.

Automatic renewal. Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Easy cancellation. You can cancel your subscription at any time from your account settings — no phone calls, no hoops. Cancellation takes effect at the end of your current billing period. We will send a confirmation email when your subscription is canceled.

Refunds. All subscription fees are non-refundable except as expressly stated here or required by applicable law. If you cancel your subscription, you will not receive a refund for any fees already charged, but you will continue to have access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods, downgrades, or unused features.

Cooling-off period. If you are charged for a paid plan and have not used any paid features (such as AI generation on a paid model or paid exports), you may request a full refund within 48 hours of being charged by contacting support@pyntra.ai. This applies to first-time charges and accidental renewals only. Once you have used paid features in the current billing period, this cooling-off period no longer applies.

Discretionary credits. In exceptional circumstances (such as extended service outages or billing errors), we may, at our sole discretion, offer account credits. Credits are not redeemable for cash and expire if your account is closed.

Price changes.We may change our prices with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Free tier. The free plan may be subject to usage limits and feature restrictions. We reserve the right to modify the free plan at any time.

8. Data Retention & Deletion

We retain your account data and content for as long as your account is active. If you delete your account, we will delete or anonymize your personal data and content within 30 days, except where we are required to retain it by law (e.g., billing records). Some data may persist in encrypted backups for a limited period before being purged.

You may request deletion of your account and associated data at any time by contacting support@pyntra.ai.

9. DMCA & Copyright Policy

We respect intellectual property rights and expect our users to do the same. If you believe that content on Pyntra infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice must include:

• Identification of the copyrighted work you believe is being infringed.
• Identification of the infringing content and its location on Pyntra.
• Your contact information (name, address, email, phone).
• A statement that you have a good-faith belief the use is not authorized.
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We may remove or disable access to allegedly infringing content and may terminate the accounts of repeat infringers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHUT.AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless WHUT.AI LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

12. Termination

By you. You may stop using the Service and delete your account at any time through your account settings or by contacting us.

By us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violations of these Terms. In the event of termination for cause, we may delete your account and content.

Effect of termination. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.

13. Dispute Resolution

Informal resolution. Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at legal@pyntra.ai. We will attempt to resolve the dispute within 30 days.

Arbitration. If we cannot resolve the dispute informally, you agree that any dispute arising from these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Wilmington, Delaware, or remotely as mutually agreed.

Class action waiver. You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Exceptions. Either party may seek injunctive relief in any court of competent jurisdiction for matters related to intellectual property or unauthorized access.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Delaware.

16. General Provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WHUT.AI LLC regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
